Is this disability fraud?
First of all, im asking for an answer, NOT your negative opinion on my question, reasoning, etc. If your rude or give negative response, your gonna get reported on here for harassment, because doing something i asked you not to do is harassment.
Anyways, here is the scenario for those who actually do give good answers on here:
This lady i know says she has Fibromyalgia. She claims that she cannot work, etc because of it, because she is always in pain and whatnot. She receives full disability for it.
However, this same lady is out doing yard work, mowing her lawn, even moving furniture in/out of her home by herself. All of this is on video. If she can do all these things, then i think she can work just fine. Is this fraud?
1. Doing something contrary to what a person asked is NOT considered harassment. Expressing an honest opinion in a relatively polite manner regarding your question, reasoning, etc. is covered under free speech. And when you post your question in a public forum, you are inviting this.
2. No. It’s not fraud. That she is physically capable of engaging in some physical activity does not mean she is physically capable of holding down a full time job. Fibromyalgia is a phenomenally painful condition – and sufferers have good days and bad days. That she can do yard work or mow her lawn or carry furniture periodically does NOT mean she is automatically physically capable of full time employment. She could be perfectly capable of working for three months and then she could go through a really bad patch with her Fibromyalgia and be incapable of leaving the house for two weeks. She would lose her job – because employers tend to get a little grumpy when employees aren’t reliable. Additionally, her Fibromyalgia symptoms are probably better controlled because she is not working – stress and sleep deprivation escalate the symptoms. Finally, she could be on powerful narcotics to control the pain – if you were an employer, what kind of job would you allow your employees to do while doped up to the eyelids?
If your neighbor was on disability for a BACK injury and was doing all of these activities, I would absolutely say that you’re right and this is probably fraud. But here, your neighbor has a confirmed diagnosis of a very debilitating disease. It’s not fraud.
