What are my rights when purchasing a property where sellers left lost of furnitures/rubbish for me to clear?
Just bought a house, when we enterred the house the vendors left a note saying they were going to collect 2 beds they had left and they never came, even when contacting them on the phone and they promised to collect they never did. On top of that they left 2 huge wooden broken wardbrobes in each rooms, bin bags full of their junk, a hoover, kids bulky toys in the garden and rubbish at the front of the house. This is a breach of contract as far as I’m aware. We instructed our solicitors to get hold of them to pay for a skip to get rid of their rubbish but still waiting for a response ( its been 2 days since instruction) What if the sellers never reply and choose to ignore this request? Can we take them to court over this and more? It’s caused us a lot of stress / slepless nights / made us ill and hiring a skip will be around £ 200 , money which we cannot afford since the entire house is falling apart! Please can a lawyer or someone who’s had the same experience advise ASAP? Thanks!
The contract of sale usually stipulates the condition the house is supposed to be in as of closing date. Was this stuff there when you did the walk-through the day before or morning of sale? You could have & should have held up the sale until contract conditions were met, or else received compensation from the sellers.
Now you have to go back to your closing attorney/closing agent, who has to go back to sellers’ attorney, and get this sorted out. If you are more than a couple of days past closing, you have a problem! But your closing atty is responsible for handling it. If it becomes necessary to sue, have your closing atty handle that and get all legal fees and court costs, compensation for you, plus costs of removal of the junk and cleaning the house to the standards stipulated in the contract.
Lessons to remember next time: Read your contract, make sure contract terms are met BEFORE you pay your money, & follow up immediately – that day, not next week/next month/next year.
